Conditions of sale

Please read carefully, especially (but not limited to) our rights of cancellation and returns under Conditions 7 and 8 and our exclusion of liability under Condition 10.

1. General Conditions

1.1 These Conditions of Sale apply to the sale by us of any products listed on this website to you. Please read them carefully before ordering any products from this website. Please understand that by ordering any products you agree to be bound by these Conditions of Sale, as set out below.

1.2 You should print a copy of these Conditions of Sale for future reference.

1.3 If you accept these Conditions, please click on the “I Accept” at the end of the order process. Please understand that if you do not accept these Terms of Sale, you will not be able to order any products from this website.

1.4 This website is operated by The Swatch Group Trading (Thailand) Co., Ltd., Head Office, 87, Room 1, Floor G, 4 M. Thai Tower, All Seasons Place, Wireless Road, Lumphini Subdistrict, Pathum Wan District, Bangkok 10330  (“we”, “us”, “our”, “Tissot Thailand”), registered in Thailand under the registration number 0105540082744, which is also used as the tax identification number. The Swatch Group Trading (Thailand) Co., Ltd. is a subsidiary of The Swatch Group Ltd., registered in Beale Switzerland

2. Your status

2.1 By placing an order through our website, you confirm that

2.1.1 You have the legal capacity to enter into binding contracts.

2.1.2 You are at least 18 years of age.

2.2 If you are entering into a contract as a consumer, please note that neither the contract between you and us nor these Terms of Sale will affect your statutory rights as a consumer.

3. Purchase of Products, Order Process

3.1 Your order for Products will be considered an offer to purchase Products under these Terms of Sale.

3.2 After placing an order, you will receive an email from us stating that we have received your order, but this does not mean that your order has been accepted.

3.3 The product listings are correct as of the date of publication. However, this is subject to availability or changes without notice.

3.4 Orders are subject to acceptance by Tissot Thailand and the availability of the products ordered. Tissot Thailand is not responsible for typographical or graphic errors.

3.5 If the products you have ordered are not available, we will notify you by email and you may choose to wait until the products are back in stock or cancel the order.

3.6 We will confirm acceptance of your order by sending you such confirmation by email and in such case, a binding contract will form between you and us.

3.7 Such contract will only relate to the products we have confirmed in the order confirmation. We are not obliged to supply any other products that do not form part of your order until such other products have been confirmed by a separate order confirmation.

4. Price and Payment

4.1 The price of the Products shall be as shown on this Website from time to time, unless there is an obvious error. When you purchase a Product from the Website, you will pay the price shown. (including VAT at the current rate) and delivery costs (if applicable) will be included in the total amount as set out in our Delivery Costs (Delivery and Returns) Guide.

4.2 Prices are subject to change at any time but such price changes will not affect orders for which we have sent you an Order Confirmation.

4.3 Our website contains a large range of products and, despite our best efforts, it is possible that some products available on our website may be listed at an incorrect price. Normally, we check prices as part of the shipping process so that where the correct price of a product is lower than the price we have quoted on the website, we will charge the lower price when we ship the product to you. If the correct price of a product is higher than the price we have quoted on the website, it will normally be at our discretion to contact you before shipping the product or to reject your order and notify you of such rejection.

4.4 Where a pricing error is obvious, unlikely to be true and could reasonably be accepted by you as an error, we are not obliged to supply the product to you at the incorrect price. (at a price lower than the correct price) whether after we have sent you an Order Confirmation.

4.5 Payment may be made by credit card / debit card as detailed in the Order Confirmation. We will display the price you pay in the Order Confirmation. We will not charge your credit card / debit card until we have dispatched the Products as ordered.

4.6 All cardholders are subject to verification that their cards are valid and subject to the authorization of their card issuers. We may share cardholder personal data with such third parties as may be necessary to enable us to carry out such checks. If the card issuer refuses to pay us, we will not be liable for any delay or non-delivery of the Products.

4.7 Payment is required prior to delivery of the Products. We will debit your credit/debit card for full payment prior to delivery of the Products. We may extend delivery of the Products until full payment has been received. We may terminate our contract with you by written notice with immediate effect if you fail to pay on time without reasonable cause.

5. Delivery

5.1 We will confirm the delivery date to you (including tracking numbers) by issuing a dispatch notice. Dispatch will normally be made within 2-7 days (or longer, but not exceeding 30 days) after the date of order, unless otherwise agreed at the time of order. If certain Products in your order will be available at different times We may offer you the option to receive the Products in instalments.

5.2 The delivery location will be as specified in the Order Confirmation. We will only deliver within Thailand.

5.3 If we are unable to meet the estimated delivery date in the Order Confirmation and the delivery date is more than 30 days from the date of the order, we will contact you to inform you of the new delivery date. If you refuse the new delivery date and we are unable to deliver the Products within 30 days from the date of your order or fail to deliver before the new date (if agreed), you may cancel your order without any charges and receive a full refund. In the event that the Products are delivered in instalments, each delivery shall not exceed 30 days from the date of the order, unless otherwise agreed at the time of placing the order.

6. Transfer of Title and Risk

6.1 Title to the Products shall pass to you upon our receipt of full payment for the relevant Products (including delivery costs) or upon delivery of the Products to you, whichever occurs later. We may return any Products delivered at any time before title is transferred if you breach these Terms of Sale.

6.2 Risk in the Products shall pass to you upon delivery. Risk referred to in this clause means liability for damage caused to or arising from the use, handling or storage of the Products.

7. Right to cancel

7.1 Please notify us of any loss, damage or defect in the Products immediately after delivery or as soon as you become aware of them.

7.2 If you are contracting as a consumer, you may cancel the Contract between us and you for any reason at any time no later than 7 days after receipt of the Products, without incurring any obligation or liability to Tissot Thailand. You may notify us in writing using the cancellation form available here. 7.3 If you cancel the contract, you must return the product (including any accessories included in the price of the product) within 14 days from the date of termination in the same undamaged condition and at your expense. If the accessories included in the product are not returned in their entirety, we are entitled to charge you for any missing parts. You must take reasonable care of the product until it is returned.

7.4 On termination of the contract between you and us, we will refund the price paid by you to us within 15 days.

7.5 After termination of the contract, you must return the product to us at the address specified in clause 9.6. The return must not be sent to another location and/or stored elsewhere. 7.6 Details of your legal rights to cancel the Contract and how to exercise this right are set out in our Order Confirmation.

8. Our Refund Policy

8.1 Where you return a Product to us claiming that it is defective, we will inspect the Product returned and notify you by email within a reasonable time of receipt of the refund. We will refund any money received by you by the same method that you used to pay us for the Product, unless you have expressly agreed otherwise. We will normally process the refund as soon as possible and in any event within 15 days of us confirming to you by email that you are entitled to a refund because the Product is defective.

8.2 Products returned by you because of defectiveness will be fully refunded including the refund of the shipping costs of the Product to you. and the reasonable costs incurred by you in returning the Product to us.

8.3 Contracts cancelled within the 7-day cancellation period (see clause 7.2 above) will be fully refunded, including the costs of sending the Product to you. If you choose a more expensive shipping method, we will be entitled to compensate you only for the amount that would have been paid if you had chosen a cheaper and generally accepted shipping method offered by us. However, you will be responsible for the costs of returning the Product to us.

8.4 You must take reasonable care of the Product until it is returned. For example, if a watch is returned to our warehouse with a strap that is damaged in any way (not due to our fault or negligence) or is not in the same condition as before, we reserve the right to refuse to accept the return or to refund the price of a new strap.

9. Your legal rights, repair and replacement

9.1 Summary of your legal rights. We are legally obliged to deliver the Product in accordance with the Contract. Please see clause 9.2, which outlines your main legal rights in relation to the Product. Nothing in these Conditions of Sale shall affect your rights.

9.2 Warranty of the watch All watches offered on this website have the additional benefit of The Tissot S.A.'s International Warranty against defects in material or workmanship. The full terms of the warranty are contained in the International Warranty Certificate, which accompanies each watch. This warranty is in addition to and does not affect your legal rights.

9.3 Claims under the warranty may be made to an authorized Tissot retailer or by returning the product to Tissot Thailand. Claims under the warranty must be accompanied by proof of purchase, which can be verified by the date of purchase. Please note that for online sales, the International Warranty Certificate, which accompanies each watch, cannot be used as proof of purchase. The following documents can be used to prove purchase.

9.4 Original delivery document

9.4.3 If no proof of purchase document is available, the Product is under warranty for a verifiable period.

9.5 Any Product returned pursuant to the Contract between you and us should be sent by registered mail with insurance to:

10. Liability

10.1 We will be liable to you for any foreseeable loss or damage caused by us. If we breach these Terms of Sale, we will be responsible for any foreseeable loss or damage suffered by you as a result of our breach of contract or our failure to exercise reasonable care and skill, but we will not be responsible for any loss or damage that is not foreseeable. Foreseeable loss or damage may be either obvious or known at the time of the contract, for example, if you discussed or discussed it with us during the course of the sale.

10.2 We do not exclude our liability to you where such exclusion is not legally possible, including the following:

10.2.1 For death or personal injury caused by our negligence.

10.2.2 For defects in the Products.

10.2.3 For fraud by misrepresentation.

10.2.4 For breach of your legal rights in relation to the Products as set out in clause 9.2.

10.3 We are not liable for any business losses if you use the Products for commercial purposes. Business or for resale, we shall not be liable to you for any loss of income, loss of business, loss of profits or loss of contracts, loss of anticipated savings, loss of data, loss of management or working time, or any non-direct or consequential loss or damage of any kind and whether arising from tort (including negligence), breach of contract or otherwise, even if foreseeable.

11. Miscellaneous

11.1 Assignment of rights and obligations. The contract between you and us is binding on you and our heirs and assigns. You may not assign or take the contract or any rights or obligations under the contract, or otherwise dispose of it, without our prior written consent (which we shall not delay in giving unreasonable consent). However, you may assign the Tissot S.A. International Warranty for the watch in accordance with the terms of the warranty to the person to whom you transfer the watch. and notify us. We may transfer, sub-contract or otherwise transfer all or any of our duties or rights under the Contract between us and you to a third party, in particular to another affiliate of The Swatch Group Ltd., without such transfer or sub-contracting affecting your use of the Products and your rights or remedies under the Contract.

11.2 Severability. If any part of these Terms of Sale or our Agreement is held to be unlawful, void or unenforceable for any reason, the remaining terms, conditions and provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

11.3 Written Communications. Applicable law requires that certain notices or communications we provide to you be in writing. By using our website, you accept that our communications are primarily electronic. We may communicate with you by email or by posting notices on our website. For contractual purposes, you agree to these electronic communications and you acknowledge that all contracts, notices, notifications and other communications we provide to you electronically are subject to the law’s requirement for such communications to be in writing. These conditions do not affect your rights.

11.4 Notices All notices you give us must be sent to The Swatch Group Trading (Thailand) Co., Ltd., Head Office, 87, Room 1, Floor G, 4 M. Thai Tower, All Seasons Place, Witthayu Road, Lumphini Subdistrict, Pathumwan District, Bangkok 10330 or by contacting us. We may give notice to you by email or by post to the address you gave us when ordering the Products or by any other method specified in Clause 11.3.

11.5 Events beyond our control If the delivery of our Products is delayed due to a cause beyond our control, we will contact you as soon as possible to inform you and we will take steps to mitigate the impact of the delay. If we do this, we will not be liable or responsible for any failure or delay in performing any of our obligations under the Contract between you and us that is caused by such a cause beyond our control, but if there is a risk of significant delay, You may contact us to cancel the contract and receive a full refund for products that you have paid for but have not yet received.

11.6 Waiver If we do not promptly insist on you doing something that you are required to do under the contract between you and us or these Terms of Sale, or we delay in taking action against you in relation to a breach of contract by you, this will not mean that you will not have to do so and will not prevent us from taking action against you at a later date.

12. Our right to change these Terms of Sale

12.1 We have the right to amend and vary these Terms of Sale from time to time.

12.2 You will be subject to the policies and terms of sale in force at the time you order products from us, unless a law or competent authority requires such amendment to the policies or terms of sale (in which case your previous order will apply).

13. Law and Jurisdiction

13.1 Contracts for the purchase of products through this website shall be construed and governed by the laws of Thailand. The relevant courts of Thailand shall have jurisdiction to consider any disputes arising from the contract between you and us and from these Terms of Sale.
